“Dog Sniff” Establishing Probable Cause During Traffic Stop
TALLAHASSEE, Fla.—The United State Supreme Court today ruled in favor of the State of Florida in Florida v. Clayton Harris, deciding that police dog Aldo’s sniff constituted probable cause for Liberty County K-9 Officer William Wheetley to search Clayton’s Harris’s vehicle for illegal drugs. The Court’s decision is important to law enforcement officers throughout the nation because it clarifies the legal standards governing their reliance on drug detection dogs, a common law enforcement practice.
The Supreme Court unanimously reversed the Florida Supreme Court’s judgment and declared, “Because training records established Aldo’s reliability in detecting drugs and Harris failed to undermine that showing, we agree with the trial court that Wheetley had probable cause to search Harris’s truck.”
“This victory is paramount to preserving our law enforcement officers’ ability to use police dog alerts to locate illegal drugs and arrest those who possess them," stated Attorney General Pam Bondi. "The Supreme Court correctly held that a police dog’s reliability is determined through a common-sense evaluation of the relevant circumstances, rather than through a rigid set of judge-created requirements."

Eugenia S. Gause, 89, of Blountstown, Florida passed away Saturday, February 16, 2013, in Blountstown.
She was a retired waitress and was of the Protestant faith. She was preceded in death by her parents.
A graveside service will be held at 9:00 a.m., Wednesday, February 20, at Pine Memorial Cemetery. Interment will follow.

Mr. Raymond Randall (Ray) Ward, 68, of LaGrange, GA, passed Friday, February 15, 2013, at his home.
Ray was born on September 18, 1944, in Pensacola, FL, and had lived in LaGrange since 1986, coming from Milton, FL. He worked in construction for a number of years and was a missionary minister for over 40 years. Ray was a Veteran of the Vietnam Conflict serving in the United States Army.
He was preceded in death by his wife, Betty Ward, and a brother, Clayton Ward.
Survivors include a son, Gregory Dewayne Ward, and his wife, Patricia, of Valley, AL; a daughter, Judy Kay Ward, of Blountstown; six brothers, Marvin Ward of Milton, FL, Richard Ward and his wife, Betty, of Pensacola, FL, Charles Ward and his wife, Sherry, of Seneca, MO, Jim Ervin Ward and his wife, Debbie, of Avon, CT, John Ward and his wife, Rita, of Milton, FL, Billy Ward of Milton, FL; four sisters, Margie Hahun and her husband, Gene, of Hudson, FL; Carol Kimbell and her husband, Clifford, of Sevierville, TN; Katrene Turner and her husband, David, of Milton, FL; Voncille Amore’ and her husband, Joe, of Sevierville, TN; two grandchildren, Randall James Ward and Anthony Nathaniel Ward.
Funeral services will be held Tuesday, February 19, at 12:00 pm CST at Peavy Funeral Home Chapel with Reverend Harold Burkett and Reverend Carlton Cain officiating. Interment will follow in Page Pond Cemetery in Altha. The family will receive friends Tuesday, February 19, from 11:00 am until service time at 12:00 pm CST at Peavy Funeral Home Chapel. All arrangements are under the direction of Marlon Peavy at Peavy Funeral Home in Blountstown (ph. 674-2266).

Mrs. Mary Magdalene Yoder Gerber went home to be in the arms of Jesus, Wednesday, February 13, 2013, after a lengthy illness.
Mary was born on August 7, 1927, in Nappanee, Indiana to Daniel and Mable Bliele Yoder. The family moved to Fairview, Michigan, in her younger years where she lived most of her life. She married Peter A. Gerber, Jr. September 25, 1946, and had four Children, JoAnn, Gloria, John and Dana. After her beloved husband’s sudden death in 1999, she moved to Blountstown, Florida, to be near her daughters. She was of the Mennonite faith and attended the Red Oak Mennonite Church in Blountstown.
She was preceded in death by her father and mother, Daniel and Mable Yoder; her loving husband of 52 years, Peter A. Gerber, Jr.; two sons, John Gerber and Dana Gerber; a granddaughter, Janice Lynn Nissley; a grandson, Hugh Knowles; a daughter-in-law, Doris Gerber; a son-in-law, Dr. Henry Knowles; three sisters, Orpha Yoder, Betty Yoder, and Ruby Handrich; two brothers, Wayne and Glenn Yoder; and two sisters-in law, Irene Yoder and Edna Yoder.
She is survived by her two daughters, JoAnn Nissley and her husband, Reverend Ivan Nissley, of Blountstown, FL, and Gloria Atwell and her husband, James, of Marianna, FL; five grandchildren, Lenora Nissley, Joy Nissley, Dr. Henry Knowles, Jr. and his wife, Kelly, Tim Knowles and his wife, Holle, Tammy Glaze and her husband, Dr. Michael Glaze; 10 great-grandchildren, Austin Nissley, Taylor Belle, McKenzie, Michael Glaze, Jr., Henry III, Benjamin, Mark Knowles, Isabella, Trystan, Hugh Knowles; two brothers, Floyd Yoder and Robert Yoder; two sisters, Ethel Handrich and her husband, Vergil, and Ruth Sharp and her husband, Dennis; and a brother-in-law, Richard Handrich.
Funeral services will be held Sunday, February 17, at 2:00 pm (CST) at Red Oak Mennonite Church in Blountstown with Pastor Rocky Weaver officiating. Interment will follow in Red Oak Mennonite Cemetery. The family will receive friends Saturday, February 16, from 6:00 pm until 8:00 pm CST at Peavy Funeral Home.
